Objetivamos elaborar um balanço sobre lógica das perguntas científicas na produção do conhecimento stricto sensu. Tomamos como fontes 100 dissertações e 32 teses escritas por docentes que trabalham em cursos de Educação Física no Estado da Bahia – 1982 a 2018, abordando enquanto objeto a lógica instituída pelas perguntas científicas na referida produção. Trata-se de uma pesquisa documental, tendo como método o materialismo histórico e dialético. Os resultados apontam que 48% das produções têm suas perguntas de investigação construída a partir (...) da lógica formal; 28% apresenta uma lógica dialética na elaboração das perguntas científicas; e 24% não apresentam problema de investigação. Esse trabalho sistematiza a experiência de um estudo de caso realizado por um coletivo de pesquisadores em formação no grupo de LEPEL/FACED/UFBA. Têm em consideração, condições objetivas concretas de uma pesquisa em rede, promovida a partir de um trabalho voltado para elevar o pensamento teórico-metodológico de pesquisadores. Os resultados apontam que uma consiste formação de pesquisadores em rede, visando elevar o pensamento teórico-metodológico, requer estudos em uma rigorosa matriz categorial de referência marxista, cuja concepção histórica se pauta em conceber de (...) forma crítica o intercâmbio do modo de produção econômico capitalista, que engendra a produção do conhecimento científico. Este artigo propõe uma discussão sobre jornalismo e subjetividade a partir de uma argumentação que considera que, embora o discurso hegemônico sobre a instituição se construa a partir do ideal da objetividade, de um texto constituído apenas pelos fatos e cujo autor deixa de ser sujeito para assumir a identidade de jornalista, a subjetividade foi sempre constituidora do texto jornalístico. Assim, pensando a partir dos estudos culturais o jornalismo como uma instituição social com formas, valores e funções conformados historicamente, e (...) os sujeitos como indivíduos que se reconhecem a partir de uma ampla rede de relações de poder, de tradições culturais, de representações de identidades, argumentamos que, em um contexto cada vez maior de centralidade dos sujeitos na cultura contemporânea, os discursos sobre si tem sido uma forte tendência também no jornalismo. Adotando como referencial teórico a obra de Jürgen Habermas, bem como as bases para o seu pensamento na Escola de Frankfurt, o presente artigo busca analisar em que medida o horizonte que se vislumbra diante da crise sanitária pode ser tomado em perspectiva para se pensar a questão do direito ao meio ambiente sustentável. Para tanto, realizou-se uma pesquisa qualitativa, sob o método hipotético-dedutivo, em uma abordagem exploratória e adotando a técnica de pesquisa bibliográfica. Ao final, conclui-se que a racionalidade (...) moderna necessita de novos paradigmas na relação homem-natureza, a qual não se pode ser mediada pela razão instrumental hegemônica. (shrink)

O artigo é um estudo de caso à luz da filosofia jurídica de Dworkin. Tratou-se de recursos especial repetitivo do Superior Tribunal de Justiça, que inviabilizou a utilização da indenização punitiva, espécie de responsabilidade civil derivada da common law. A pesquisa busca analisar o voto vencedor, propondo argumentos com uso da tese do ativismo judicial sobre a possibilidade de utilização da punitive damage em matéria ambiental. O presente trabalho foi desenvolvido sob a metodologia jurídico-teórica e raciocínio dedutivo, com pesquisa bibliográfica (...) e jurisprudencial. Conclui-se que por meio do ativismo judicial há possibilidade de aplicação da indenização punitiva em matéria ambiental. (shrink)

Este artigo objetiva apresentar os resultados de uma investigação sobre a influência do contexto histórico-literário do niilismo russo — com destaque para o papel desempenhado pelo romance Pais e Filhos — no desenvolvimento das primeiras reflexões de Nietzsche sobre o niilismo, as quais foram registradas em dois textos póstumos de 1880. Principiando com um esclarecimento sobre a origem da palavra niilismo, o texto prossegue com uma caracterização do contexto social, político e cultural do Império Russo na segunda metade do século (...) XIX. Na sequência, apresentamos uma análise das diferentes definições do que é um niilista apresentadas no romance de Ivan Turguêniev para, em seguida, investigar o impacto que esta publicação gerou na sociedade russa da época. A partir de todos esses subsídios históricos, a última parte do artigo apresenta uma interpretação dos dois fragmentos póstumos que dialoga diretamente com a interpretação desenvolvida por Elisabeth Kuhn, ora concordando, ora refutando certos aspectos dela. The events of September 11th, 2001 have irreversibly marked the outlook of the entire world in the beginning of the twentieth-first century and its consequences will certainly continue to be felt for years to come. Although relatively new, such events have not passed without receiving attention from some among the foremost thinkers of our time. Given that, we intend to develop an interpretative hypothesis which, starting from the perspective opened by the reflections of Friedrich Nietzsche concerning the nihilism and the (...) great politics, seeks to understand both the violent actions which try to justify themselves from a fundamentalist world view as well as the recent political and military configuration of the U.S. liberal democracy as different forms of reaction against the deepening of the value crisis ​​through which the Western world passes. Zu Nietzsches Selbsteinschätzung als Schicksal der Philosophie und der Menschheit " - originally published in Nietzsche-Studien 37 - which was specially prepared to be presented in lecture organized by the Grupo de Pesquisa Spinoza & Nietzsche, in the Universidade Federal do Rio de Janeiro, on September 14, 2009. In the text, the autor employs his own philological-hermeneutical methodology, which is called contextual interpretation, in the purpose to (...) clarify the concepts of the first aphorism from "Why I am a destiny", from Ecce Homo, in its own context, in the context of Ecce Homo and in the context of the entire work from Nietzsche. This article puts forward solutions to some of the ethical and legal dilemmas posed in the current discussion on how to program crash algorithms in autonomous or self-driving cars. The first part of the paper defines the scope of the problem in the criminal legal field, and the next section gives a critical analysis of the proposal to always prioritise the interest of the occupant of the vehicle in situations with conflict of interests. The principle of minimizing social damage as (...) a model for configuring self-driving cars is examined in the third section. Despite its apparent plausibility, within the framework of a liberal legal system that recognises humans as free agents who have rights and responsibilities, maximizing the function of social utility does not justify harmful interference into a person’s legal sphere. Therefore, in the fourth part, the author argues the need to program the crash algorithms of autonomous cars based on a deontological understanding of the system of justifications in criminal law. The solution to the dilemma lies in a prior analysis of the legal positions of all agents involved in the conflict, from a perspective of the principles of autonomy and solidarity as the core of the system of justifications. This article is a within- and cross-country examination of the impact of fair trade certification on consumers’ evaluations and attitudes toward ethically certified products. Across three experimental studies, the authors analyze how different levels of brand familiarity and fair trade expertise impact consumer decisions. The authors study this phenomenon across markets with different social orientation cultures to analyze potential dissimilarities in the way consumers evaluate and behave toward ethically certified products. Findings suggest that fair trade certifications enhance product valuations. However, (...) this effect is especially observed for low familiar brands, once the level of fair trade expertise increases. Findings also suggest that there are individual cultural differences with respect to social and environmental labeling expertise that may account for some of the unexplained variation in choice behaviors observed across countries. Results indicate that especially in more (mature) individualistic markets (vs. collectivistic) consumer ethical behavior seems to be greatly influenced by consumers’ perceptions about the eligibility of brands using (or not) fair trade. This effect is strengthened by the significant mediating role of consumers’ ethicality perceptions on the relationship between fair trade and the willingness to pay for brands. (shrink)

This paper intends to identify the functions of the French particle “comme” (“like” in opposition to “as”) and “comme si” (“as if”) in the work of French contemporary philosopher Jean-Luc Marion, especially in L’idole et la distance (American translation: The Idol and Distance), Dieu sans l’être (American translation: God without Being), Étant donné (American translation: Being given) and De surcroît (American translation: In excess). The author of this paper focuses on the relation between phenomenology and theology in order to demonstrate (...) its complexity by an analysis of linguistic phenomenology. At the end of this analysis, the “saturated phenomenon”, as proposed by Jean-Luc Marion, becomes an important notion to understand the boundaries of both disciplines, phenomenology and theology. There are certain terms which, for reasons no longer discoverable, have taken on an emotional force which impels people either to admire what they seem to stand for or to dislike it. Among such terms are the temporal and the eternal, the dynamic and the static, the unified and the multiple, the universal and the local. At the present time to say that a work of art, for instance, has been “universally admired” is presumably also to say that it is (...) better than one which is admired only in France or Italy or the United States. To say that courage or truthfulness or charity have always been “highly esteemed” is also to say that they are inherently nobler qualities than, for example, originality or wit, which are highly esteemed only in certain epochs. It is this curious aura of emotivity which Professor A. O. Lovejoy in one of his ingenious terminological inventions once called “metaphysical pathos.” “Metaphysical pathos” is not merely the name for the power which terms have of stimulating pleasant emotions, of making men feel that the things they name are good. It may also be of an unpleasant sort. It may induce dislike as well as admiration. Where one man speaks of the dynamic with something approaching awe, another calls it “aimless striving” or “spiritual restlessness,” forgetting that only a hundred and fifty years ago the German Romantic philosophers could think of no nobler end of man than striving for striving's sake. Hence it is always useful and for the most part necessary to look closely at those abstractions by means of which we justify our programs. It is for this reason that it may be well to examine one of our own sacred words, “tradition,” which seems to have replaced even that perennial favorite of the poets, “nature.”. (shrink)

Noël Carroll denies and Robert Stecker affirms that it is a necessary condition of aesthetic experience that it should be valued for its own sake. I make use of their controversy to argue for the psychological impossibility of discharging very common practices of art evaluation and analysis without undergoing an aesthetic experience valued for its own sake. By way of supporting my thesis and also making progress in Stecker and Carroll’s dispute about aesthetic experience, I analyse their methodological assumptions and (...) develop further our understanding of negative, indifferent and unexpected aesthetic experiences. The article provides a defence of Stecker’s position based on my contention regarding art evaluation and analysis. (shrink)

Germany is joining a long list of European democracies that have modified or expressed a willingness to modify their citizenship laws to denationalize first and then prevent the return of or expel those citizens accused of having participated in terrorist activities abroad. The formal labelling of citizenship deprivation as an administrative measure outside the scope of criminal justice has prevented scholars of criminal law from undertaking a thorough scrutiny of its legitimacy. In this paper I seek to fill this gap. (...) Specifically, after demonstrating why deprivation of citizenship is a measure of a criminal nature, I argue against its legitimacy, either as a punishment or as a risk-based measure. Instead I propose that we should understand citizenship deprivation as a paradigmatic response from an illegitimate enemy criminal law. Notwithstanding the foregoing, I claim that states that choose to denationalize terrorists should do it within the framework of a process with the highest (criminal procedural) guarantees. (shrink)

Among the advocates of expressive theories of punishment, there is a strong consensus that monetary fines cannot convey the message of censure that is required to punish serious crimes or crimes against the person. Money is considered an inappropriate symbol to express condemnation. In this article, I argue that this sentiment is correct, although not for the reasons suggested by advocates of expressivism. The monetary day-fine should not be understood as a simple deprivation of money, but as a punishment that (...) reduces the offender’s capacity to consume for a certain period of time. Conceived in this manner, I argue that it is perfectly suitable to convey censure. However, the practical impossibility of ensuring that the person who pays the fine is the same person who has been convicted of the offense seriously undermines the acceptability of the monetary fine as an instrument of censure. Minimizing the risk of the fine’s hard treatment being transferred to third parties is a necessary condition for the monetary fine to be considered a viable alternative to lengthy prison sentences. ABSTRACT In the 1960s, when Dr. Belding Scribner discovered how to accomplish the process of dialysis in a repeated way, he could not imagine that in solving such a problem others as or more difficult would appear. Given the technological progress and the impossibility of assisting all patients through the most modern methods, the medical doctor often finds himself faced with the moral dilemma of choosing which patient in the waiting list will receive the treatment. This same dilemma is amplified (...) in the case of organ transplants. Professionals, students, professors of the juridical and health fields, and the population in general, were interviewed as a means of documenting the moral concepts and opinions surrounding this problem. In the reality in which we find ourselves, it seems to us that deciding who lives, and the responsibility for all the events that culminate in such decisions, is still a subject left open to discussion. Objective: This study aims to compare the acoustic vocal analysis results of a group of transgender women relative to those of cisgender women.Methods: Thirty transgender women between the ages of 19 and 52 years old participated in the study. The control group was composed of 31 cisgender women between the ages of 20 and 48 years old. A standardized questionnaire was administered to collect general patient data to better characterize the participants. The vowel /a/ sounds of all participants were collected (...) and analyzed by the Multi-Dimensional Voice Program advanced system.Results: Statistically significant differences between cisgender and transgender women were found on 14 measures: fundamental frequency, maximum fundamental frequency, minimum fundamental frequency, standard deviation of fundamental frequency, absolute jitter, percentage or relative jitter, fundamental frequency relative average perturbation, fundamental frequency perturbation quotient, smoothed fundamental frequency perturbation quotient, fundamental frequency variation, absolute shimmer, relative shimmer, voice turbulence index, and soft phonation index. The mean fundamental frequency value was 159.046 Hz for the cases and 192.435 Hz for the controls.Conclusion: Through glottal adaptations, the group of transgender women managed to feminize their voices, presenting voices that were less aperiodic and softer than those of cisgender women. O texto se propõe a examinar o procedimento desconstrutivo levado a cabo por Jacques Derrida com relação a aspectos da filosofia da linguagem em Edmund Husserl, através especialmente da investigação e crítica da natureza da significação.

El Programa de filosofía con y para niños ‘FiloHilo’ surgió de la posibilidad de trasladar desde el Prácticum a las aulas procesos de innovación y renovación pedagógica basados en el diálogo y la práctica filosófica. Son multitud los estudios que nos permiten afirmar que la Filosofía para niños/as se ha transformado en una actividad efectiva, posible y necesaria para todas las edades, ya que atiende a la necesidad propia del ser humano: la pregunta, el cuestionamiento, la duda. Pero estos procesos (...) se instauran si hay una actitud de apertura y disposición por parte del profesorado: esa primera condición, la actitud de apertura y disposición, es sobre la que se centra este artículo y fue el germen de preguntas clave: ¿cómo percibe el profesorado estas prácticas?, ¿las conocen?, ¿las han utilizado alguna vez?, ¿tienen predisposición a su implantación?, ¿está preparado para desarrollar un pensamiento ético, reflexivo, solidario y crítico en las aulas? Con el objetivo de responder a ello, se elaboró un cuestionario compuesto por 31 ítems y 4 dimensiones, que posee altos niveles de fiabilidad (α=0.949). Fue enviado a todos los centros educativos gallegos y respondido por 167 docentes. Los resultados muestran una alta predisposición hacia la práctica filosófica, fundamentalmente, por apoyar el razonamiento crítico y la toma de conciencia. Se concluye demandando un abordaje diferente de la enseñanza de la filosofía, tomando en cuenta las necesidades y los intereses del profesorado e introduciendo la necesidad de formación en el ámbito de la práctica filosófica, entendiendo la filosofía como algo que se practica y puede transformar la vida de los alumnos y alumnas: autoconocimiento y autorrealización. Recently, the mechanistic framework of active inference has been put forward as a principled foundation to develop an overarching theory of consciousness which would help address conceptual disparities in the field (Wiese 2018 ; Hohwy and Seth 2020 ). For that promise to bear out, we argue that current proposals resting on the active inference scheme need refinement to become a process theory of consciousness. One way of improving a theory in mechanistic terms is to use formalisms such as computational (...) models that implement, attune and validate the conceptual notions put forward. Here, we examine how computational modelling approaches have been used to refine the theoretical proposals linking active inference and consciousness, with a focus on the extent and success to which they have been developed to accommodate different facets of consciousness and experimental paradigms, as well as how simulations and empirical data have been used to test and improve these computational models. While current attempts using this approach have shown promising results, we argue they remain preliminary in nature. To refine their predictive and structural validity, testing those models against empirical data is needed i.e., new and unobserved neural data. A remaining challenge for active inference to become a theory of consciousness is to generalize the model to accommodate the broad range of consciousness explananda; and in particular to account for the phenomenological aspects of experience. Notwithstanding these gaps, this approach has proven to be a valuable avenue for theory advancement and holds great potential for future research. (shrink)

In this paper we state that, up to now, scholars have read the Husserliana—that is Husserl’s official texts—only partially. This statement must be considered within the History of phenomenology and, more precisely, with-in the history of Husserlian studies: from Heidegger to Jean-Luc Marion, including Levinas, Ingarden, Sartre, Merleau-Ponty and so on, Husserl’s texts have been read only partially. With the exception of some analysis proposed by Derrida—or, nowadays, by Natalie Depraz or Elianne Escoubas—, and as far as I know, all (...) the interpretations of Husserl’s texts have considered them just as a support to ex-pose theories or to describe phenomena, but not in themselves, that is, not as texts. Our aim here is then to propose a new perspective to to phenomenalize Husserliana as a text and focus precisely on Husserl’s praxis of writing. Here we will develop specially an analysis of one mode of writing used in Husserl’s praxis of writing and called: bildliche Rede. We will finally compare the results of our analysis to Heidegger’s and Jean-Luc Marion’s praxis of writing.Podem afirmar que, fins avui, els in-vestigadors han llegit la Husserliana —és a dir, els textos de Husserl publicats de manera ofici-al— només parcialment. Cal considerar aquesta afirmació en el marc de la Història de la feno-menologia i, més precisament, en el marc de la història del estudis husserlians: des de Heidegger fins a Jean-Luc Marion —més de cent any de fenomenologia—, els textos de Husserl han estat considerats només com a suport per a exposar teories o descriure fenòmens, però no s’han considerat en ells mateixos, és a dir, no com a textos. Posant en pràctica l’acció de “llegir fenomenologia” en un nou sentit fort del verb “llegir”, aquest article comença identificant els diferents modes de la praxis d’escriptura de Husserl. Després ens concentrarem en un d’aquests modes d’enunciació, anomenat “bildliche Rede”, per desenvolupar així una història de la figurativitat. Finalment, esbossa-rem una breu comparació dels resultats amb la praxis d’escriptura de Heidegger i Marion. (shrink)
